Accra High Court Rules in Favour of GACL, Orders Repossession of McDan-Controlled Airport Lands

The Ghana Airports Company Limited (GACL) has successfully repossessed significant parcels of prime airport land from the McDan Group of Companies following a decisive ruling by an Accra High Court.

The judgment, delivered on May 6, 2025, grants GACL full re-entry and possession of over 16 acres of land that were previously occupied by subsidiaries within the McDan Group.

The lands in question, specifically measuring approximately 10.63 acres and 5.66 acres, are strategically located adjacent to and opposite the Action Chapel International, in close proximity to the Kotoka International Airport (KIA).

These lands had been under the control of McDan Shipping Company and Airport Logistics Limited, both entities within the McDan Group, since 2012.

The legal battle commenced in February 2025 when GACL filed a writ and statement of claim against the two McDan Group subsidiaries. GACL cited persistent breaches of the existing land lease agreements and significant outstanding ground rents as the basis for their legal action.

 

The company sought the recovery of $26,296 in accrued ground rent for the prolonged use of the properties. Furthermore, GACL pursued a perpetual injunction to prevent the defendants from any future interference with the reclaimed lands.

Following the legal proceedings, GACL applied for a summary judgment, arguing that the McDan Group entities had no credible defense against their claims.

The Accra High Court ultimately ruled in favour of GACL, granting all the reliefs sought by the airports company. In addition to reclaiming the land, the court ordered the defendants to pay GH¢50,000 in legal costs incurred by GACL.

This legal victory comes after a previous issue involving the McDan Group at KIA.

In December 2024, the operations of McDan Aviation at Terminal 1 were temporarily suspended by GACL due to outstanding debt obligations. While those specific debts were subsequently settled, the dispute over the airport lands remained unresolved, necessitating the recent legal intervention.

 

The management of GACL has warmly welcomed the court’s decision, hailing it as a crucial win in their efforts to recover valuable state assets.
