The wife of former National Food Buffer Stock Company (NAFCO) Chief Executive Officer Abdul-Wahab Aludiba has filed an urgent habeas corpus application at the High Court in Accra, seeking a court order compelling the state to produce her husband and justify his continued detention following his arrest by officers of the Bureau of National Intelligence (BNI).
Hajia Faiza Seidu Wuni filed the application on Monday, July 6, 2026, naming the Director of the BNI and the Attorney-General as respondents. She is asking the High Court’s Specialised Court to order Abdul-Wahab Aludiba’s immediate production before the court so the legality of his detention can be determined.
According to court documents, Abdul-Wahab Aludiba was arrested by armed operatives at the Accra International Airport on July 4, just as he was preparing to travel to London for medical treatment under a High Court order.
The former NAFCO CEO, who is standing trial on charges of stealing and causing financial loss to the state, had been granted permission by the High Court on June 29 to travel abroad for treatment of a worsening eye condition. The order required him to depart on or before July 4 and return to Ghana by July 14.
In her sworn affidavit, Hajia Faiza said her husband had completed all pre-departure formalities, including clearance by the Ghana Immigration Service, before he was intercepted by armed men who identified themselves as BNI officers and took him into custody without providing any explanation.
She further stated that Abdul-Wahab Aludiba was denied the opportunity to speak with his lawyer at the time of his arrest.
According to the application, family members spent several hours contacting various security agencies, all of which reportedly denied having him in custody. It was only the following day, she said, that they were informed he was being held at the BNI headquarters in Ridge, Accra.
Hajia Faiza also alleged that she was prevented from delivering food to her husband after officers at the BNI headquarters informed her that visitors were not allowed on weekends. Lawyers representing Abdul-Wahab Aludiba were also reportedly denied access, with officers citing the absence of the required clearance.
The arrest attracted public attention after Deputy Attorney-General Dr Justice Srem-Sai disclosed in a Facebook post that Abdul-Wahab Aludiba had been arrested over what he described as an attempt to access funds in a frozen bank account through improper means. According to Dr Srem-Sai, investigators suspect the former NAFCO CEO attempted to empty a Republic Bank account two days before his arrest.
The Deputy Attorney-General also indicated that the Attorney-General’s Office intended to challenge the High Court’s decision permitting Abdul-Wahab Aludiba to travel for medical treatment.
However, Hajia Faiza rejected the allegation in her affidavit, stating that her husband categorically denies attempting to access the frozen account through unlawful means. She described the allegation as baseless and called on the state to produce evidence to support its claims.
The application argues that Abdul-Wahab Aludiba’s arrest and continued detention violate his constitutional rights, including his right to personal liberty and access to legal representation. She is therefore asking the court to order the BNI and the Attorney-General to produce him before the court and explain the legal basis for his detention.
As of the time of filing, neither the BNI nor the Attorney-General’s Office had filed a formal response to the habeas corpus application. The matter is now before the High Court in Accra for determination.
