Zanetor prays court to throw out Ashietey’s case

Zanetor Rawlings, National Democratic Congress’ (NDC) Parliamentary Candidate for the Klottey Korle Constituency in the Greater Accra Region, has through her lawyers asked an Accra High Court to throw out a case brought against her by incumbent MP, Nii Armah Ashietey, seeking to challenge her candidature.

Mr. Ashietey who was convincingly defeated by Zanetor during the party’s primary in November last year, has joined forces with another defeated aspirant, Nii Johnson Coleman, to sue the daughter of former President Jerry John Rawlings on the grounds that she was wrongfully elected since she is not a registered voter.

The two are praying the court to declare her ineligible in order to pave way for a re-run of the primary. But lawyers for Zanetor on Friday asked the court to throw out the suit because it lacks merit.

The motion for dismissal of the suit has been set for 4th February 2016, when the case is recalled.

The court presided over by Elizabeth Nimako adjourned the case to allow lawyers for the plaintiffs to serve the 1st and 3rd Respondents, thus the Electoral Commission and the NDC with a hearing notice after an attempt by Lawyer for the plaintiff, Gary Nimako to subpoena the EC was overruled by the court.

According to the court, because the Electoral Commission is a party to the suit, they cannot be subpoenaed instead they should be served with a notice to appear before the court on Thursday February 4.

A similar suit, filed by some three members of the NDC in the same constituency, has already been ruled in favour of Zanetor Rawlings.

That suit is believed to have been orchestrated by the incumbent MP.
