NDC executives sue Zanetor Rawlings; want Klottey Korley Parliamentary re-run

Four National Democratic Congress executives have sued the Klottey Korley Parliamentary candidate Dr. Zenator Rawlings.

The executives are asking an Accra High Court to stop Dr. Zenator Rawlings from holding herself out as Parliamentary Candidate for the Constituency.

The petitioners- Joseph Narku Botchway, Jacob Amin, Alhaji Mohammed Mahmud and Reverend Michael Kwabena Nii Adjei Sowah insist Dr Rawlings was not qualified to contest in the primaries because she is not a registered voter.

Two others, the National Democratic Congress as well as the Electoral Commission have been joined in the suit as defendants.

The petitioners do not understand how the two institutions would allow Dr Zanetor Rawlings to contest in the parliamentary primary when she does not qualify to do so.

The writ, a copy of which is in the possession of Myjoyonline.com quoted Article 94 (1) of the 1992 Constitution which says “Subject to the provisions of this article, a person shall not be qualified to be a member of Parliament unless –

(a) he is a citizen of Ghana, has attained the age of twenty-one years and is a registered voter.

The petitioners further argue that for a person to be qualified to contest in the Parliamentary primary of the NDC, that person must be a card bearing member and must have paid his or membership dues.

It is the considered opinion of the petitioners that Dr Zanetor Rawlings is not a registered voter because her name is neither in the national biometric register compiled in 2012, nor is her name in the biometric register of the governing National Democratic Congress.

The petitioners further argue that Dr Rawlings did not vote in the November 17 2015 Parliamentary primary because her name was not in the register.

To allow her to contest in the Klottey Korle constituency primary when in fact she is not a registered voter is a palpable violation of the party’s constitution and the rules governing the Parliamentary primaries, the petitioners contended.

The petitioners are therefore asking the court to declare as null and void the results of the parliamentary elections which made Dr Zanetor Rawlings a candidate for the Klottey Korle Constituency.

The petitioners are also asking the court for an order of injunction restraining Dr Rawlings from holding herself out as parliamentary candidate until the case is determined.

They are also asking the court to re-run the Klottey Korley parliamentary elections.
