PNC congress ‘null and void’ – Lawyer Charles Bentum

The outcome of the People’s National Convention(PNC) congress held over the weekend is ‘null and void’ and does not hold legally, according to Lawyer Charles Bentum, Counsel for three aggrieved members of the Peoples’s National Convention(PNC) who sought for a restraining order in court against the PNC congress that was held over the weekend.

He said since the party flagrantly disregarded an order of injunction against the conduct of the recently held PNC congress at Wa, none of the officers elected thereof from the controversial congress cannot be said to be legally valid to hold any official position in the party.

The PNC congress has been under contention in court as some three members of the party have gone to court over what they say is the refusal of the party’s Congress Committee to disqualify one of the aspirants, Bernard Mornah for presenting a dud cheque to the party while presenting his nomination form.

The plaintiffs, David Apasera, Abubakar Sadiq Kwashie Ebla and Henry Haruna, had sought through the court to stop the congress from being held since several appeals to the party yielded no positive results.

However, the event took place despite the inability of the Accra High Court to hear the suit Friday which sought to challenged the candidacy of the newly elected national chairman of the PNC, Mr Bernard Mornah.

Commenting on the development from the contentious PNC congress on Kasapa 102.3 FM, Lawyer Bentum argues the move was in contempt of court, and must prepare themselves for a long legal battle.

“This is act of lawlessness and we must fight against it. If we continue to undermine the powers of the court then we are gradually turning our country into a state of lawlessness. If such move is indeed based on the advice of their Lawyers, then they will have themselves to be blamed for the consequences, since they are already aware of a writ of injunction that precludes the conduct of any election on the said date”, he said in an interview with Fiifi Banson on Anopa Kasapa on Kasapa 102.3 FM.
