Ayariga wins disqualification suit against EC

The Electoral Commission (EC) has been ordered by the High Court to allow the flagbearer of the of All People’s Congress Party (APC) to correct the mistake on his nomination papers.

The Court quashed the Commission’s decision to disqualify Hassan Ayariga from contesting this year’s election, citing errors on his nomination papers.

The court presided over Justice Barbara Tetteh Charway dismissed arguments by the EC that the Court had no power to order the Commission to perform a certain action because it is an independent institution set up by the Constitution.

She ordered the EC to in accordance with regulation 9 of CI 94 which govern this year’s election, allow Dr. Nduom to amend his nomination papers and submit them.

Some of the parties whose presidential nominees were disqualified from the race – the Progressive People’s Party (PPP), National Democratic Party (NDP) and Great Consolidated Popular Party (GCPP) had sued the EC praying the court to compel the commission to rope them back into the race.

The commission disqualified about 12 political parties from the presidential race.
